Port City Luggage – Terms and Conditions of Service
1. Acceptance of Terms
By accessing, booking, or otherwise using the services of Port City Luggage (“Company,” “we,” “us,” “our”), you (“Customer,” “you,” “your”) agree to be bound by these Terms and Conditions (“Agreement”). This Agreement governs all use of our baggage storage, pick-up, delivery, transportation, and any related or ancillary services. If you do not accept these terms in full, you are not authorized to use our services. Continued use constitutes ongoing acceptance.
2. Scope of Services
Port City Luggage provides temporary baggage storage and transport services within designated service areas and timeframes. Services include but are not limited to: scheduled pick-up and delivery, short-term storage, airport curbside handoffs, and optional transportation add-ons. The Company does not provide moving services, long-term storage, or insurance coverage for items beyond the expressly stated limitations herein.
3. Eligibility
By using our services, you represent and warrant that you are at least 18 years of age and legally capable of entering into a binding contract. Individuals under the age of 18 must be accompanied by a parent or legal guardian.
4. Customer Responsibilities
Customers must:
Ensure luggage is securely closed, locked, and tagged prior to pick-up.
Provide accurate pick-up and drop-off information, including addresses, contact numbers, flight details (where applicable), and special instructions.
Be available at designated times for handoff, or designate an authorized recipient.
Not pack prohibited items (see Section 5).
Verify booking details prior to confirmation, as errors may result in additional charges or service refusal.
5. Prohibited Items
Customers are expressly prohibited from storing, transporting, or concealing in luggage any of the following:
Firearms, ammunition, explosives, or weapons of any kind.
Illegal drugs, controlled substances, or paraphernalia.
Hazardous materials, chemicals, flammable items, or pressurized containers.
Perishable food, live animals, plants, or organisms.
Cash in excess of $500, negotiable instruments, jewelry, or irreplaceable valuables.
Any items prohibited under federal, state, or local law.
The Company reserves the right to inspect, refuse, or report any prohibited items at its sole discretion.
6. Limitation of Liability
Port City Luggage’s liability for loss, theft, or damage is strictly limited to the lesser of:
(a) $250 per bag, or
(b) the actual cash value of the bag and its contents as demonstrated by proof of purchase.
No coverage is provided for consequential, incidental, or indirect damages, including but not limited to missed flights, delays, emotional distress, loss of business, or lost opportunities. Customers are advised to purchase independent insurance for valuable or sensitive items.
7. Payment and Fees
All services must be prepaid through authorized payment methods. Prices are clearly stated at the time of booking and may vary based on bag count, duration, service area, and add-ons. Additional charges may apply for:
Late changes to pick-up or drop-off addresses.
Delayed customer arrivals beyond grace periods.
Oversized or overweight items.
Service outside designated operating hours.
All fees are non-refundable except as expressly provided under Section 9.
8. Cancellations and Modifications
Bookings may be modified or canceled up to 24 hours prior to scheduled service without penalty. Cancellations within 24 hours of service may incur partial or full charges at the Company’s discretion. Refunds, if applicable, will be processed within 7–10 business days.
9. Refunds
Refunds are issued only in cases of verified service failure directly attributable to the Company. Dissatisfaction with pricing, personal schedule changes, or miscommunication unrelated to Company error are not grounds for refund.
10. Service Limitations
Port City Luggage does not guarantee specific delivery times in the event of traffic, weather, mechanical failure, or other conditions beyond our reasonable control. We reserve the right to refuse service at any time for safety, security, or operational reasons.
11. Customer Conduct
Customers agree to conduct themselves courteously and respectfully toward Company staff. Abusive, threatening, or harassing behavior will result in immediate termination of service without refund.
12. Indemnification
You agree to indemnify, defend, and hold harmless Port City Luggage, its employees, contractors, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorney’s fees) arising from your use of services, violation of these terms, or inclusion of prohibited items.
13. Force Majeure
The Company is not liable for delays, failures, or service interruptions caused by events beyond our reasonable control, including but not limited to natural disasters, labor disputes, government orders, acts of war, terrorism, or internet outages.
14. Dispute Resolution
Any disputes shall first be addressed through good faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Portland, Maine under the rules of the American Arbitration Association. The decision of the arbitrator shall be final and enforceable in any court of competent jurisdiction.
15. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Maine, without regard to conflict of law principles.
16. Amendments
The Company reserves the right to amend, modify, or update these Terms at any time. Updated terms will be posted on our website and shall take effect immediately. Continued use of services constitutes acceptance of updated terms.
17. Entire Agreement
This Agreement represents the entire understanding between the parties and supersedes all prior communications, whether written or oral. If any provision is deemed unenforceable, the remaining provisions shall remain in full force and effect.
